Terms of service, returns/refunds
After your order has processed, playsets typically ship from the Gorilla Playsets warehouse in GA anywhere from 5-7 days. This time frame is dependent on seasonal months where high volumes of playsets are ordered (mid-March through August, December is also a popular month to order playsets due to the various holidays). During periods of high volume orders nationally, Gorilla Playsets may experience delays in shipping certain model playsets. It is not uncommon for playsets ordered during this time to have deliveries in the 3-4 week period or longer. Scottsswingset will make every effort to communicate to the customer if there are any anticipated delays in the delivery of their playset, but cannot be held responsible for said delays.
When your playset ships, you will receive a phone call (please include the best working phone number to reach you) from the freight delivery company to schedule delivery of your playset. Depending on the model, the playset can be as little as 3 boxes and as many as 17. The delivery company will then schedule with you, the customer to arrange a date/time to drop off the playset. It is highly recommended that an adult over the age of 18 be present, as someone will have to sign for the delivery. Delivery is curbside only; the freight company is not obligated under any circumstances to move the boxes to any other location (certain delivery companies have on occasion made arrangements with customers to assist you in moving them elsewhere). Please check all boxes for any potential damage; also, every Gorilla Playset will have a specific number of boxes. These boxes are all numbered; thus if your playset has 5 boxes, there should be a box #1 through a box #5. Generally, all Gorilla Playsets will be delivered on a wooden pallet that is shrink-wrapped in plastic (the exceptions will be smaller model playsets that do not necessitate a wooden pallet). The numbered, colored stickers will be on the ends of these boxes (and not covered). Please check the packing slip/invoice against the number of boxes to ensure everything has been delivered. ***If you have ordered a larger playset model that has a 14' Super Scoop Slide, this slide will NOT be in a box. It will be wrapped in 2 layers of heavy plastic. Please be aware that if you order a playset model with this slide, it will count against the number of boxes in your order but it will not be numbered (example: a Treasure Trove 2 playset model with a standard wood roof will have 14 boxes; 13 of those will be cardboard boxes, the 14th item will be the Super Scoop Slide that will be wrapped in plastic). Please ensure that you check the packing slip the delivery company gives you upon delivery of your playset; if there are any items not checked off, please immediately ask the delivery person/persons to check their truck for these items.
If your order arrives damaged, or is damaged during the off-loading process please contact me immediately (call/text 6319885673). I have a close working relationship with Gorilla Playsets and these types of scenarios, while rare do occur. I will work with Gorilla to remedy the situation as quickly as possible.
**If you have scheduled installation with scottsswingset, please do not open any of the boxes or cut any of the white straps. Boxes should be covered when possible, or stored in a garage/like to ensure they stay dry prior to the installation date. Installation fees are based on the installer's ability to transport dry, intact boxes to the installation area; this is not possible when the boxes are wet, opened or both.
For customers that have not purchased a playset from scottsswingset:
**If there are parts/pieces damaged from your delivery, and I have them with me (small parts i.e. wood slats, hardware, etc- this does not include any slides) the installation will be finished that day. Should major components be missing (slides, entire boxes of wood pieces, etc.) prior to the install date, I will assist with getting those components expedited to you. However I cannot hold reserved dates in that case as I have no control over the shipment of these replacement parts.
Customer must be present when installer(s) arrive to discuss placement and orientation of playset. Factors that can affect playset placement (and for which scottsswingset LLC assumes no liability) include drainage vents, sealed in dry wells, sprinkler heads/lines, sloping of the ground over an area, etc. While installer(s) will make every effort to ensure the playset is placed in accordance with the customer's request, the above listed factors (and others) may necessitate adjustments to the placement. Once the general area has been agreed/discussed prior to any assembly, the playset cannot be moved once installation has commenced. Any request to move any part of the playset, or the entire playset will incur additional charges that are dictated by scottsswingset LLC, and will be based on the complexity of the playset and the size.
Limitation of Liability
Scottsswingset.com LLC shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Scottsswingset.com LLC has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Your use of this site shall be governed in all respects by the laws of the state of N.J., U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Scottsswingset.com products) shall be in the state or federal courts located in Ocean County, N.J.. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Scottsswingset.com products) must be commenced within one (1) year after the claim or cause of action arises. Scottsswingset.com failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Scottsswingset.com may assign its rights and duties under this Agreement to any party at any time without notice to you.
You agree to indemnify, defend, and hold harmless Scottsswingset.com LLC, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
Scottsswingset.com LLC will take every necessary precaution to ensure your personal information stays private, and is never shared with any outside party. This site is encrypted with the latest SSL technology (Secure Sockets Layer) to ensure all data used during your transaction is secure. Scottsswingset.com LLC will never share a customer's information with any outside party with regard to separate services (including but not limited to installation of playset not arranged with Scottsswingset.com LLC) without the express verbal or written consent of said customer.
While all necessary precautions are taken to guard against identity theft, Scottsswingset LLC will not be held responsible for any damages/losses incurred by customer in the event said customer's privacy is compromised via transaction with Scottsswingset LLC and ecommerce store.
All items that ship free listed on scottsswingset.com are applicable only to the lower 48, contiguous US states. Additional shipping costs outside the lower 48 US states will apply.
Scottsswingset.com is committed to providing fast and efficient service. If you are not happy with your order and it is in good condition, I will refund you the total product costs that you were charged, minus the shipping costs. This policy applies as long as the item(s) are returned within 30 days from shipping date and are in the original, unopened packaging.
Orders returned do not receive shipping reimbursements and are charged the actual shipping costs, to and from the Gorilla Playsets warehouse. If a returned item was a "Free Shipping" item from Scottsswingset.com, then the refund for the product will be minus the actual shipping charges. Please save a copy of all warranty, receipts, and delivery receipts for your records. Refunds are processed within 10-14 business days from date of refund.
REPLACEMENT PARTS FOR CONCEALED DAMAGE/DEFECT OF FREIGHT
As an unavoidable part of the shipping industry, sometimes packages arrive damaged or defective, or with missing parts. Scottsswingset guarantees you will receive all parts - correct and functioning properly. All replacement part orders are shipped standard ground delivery (regardless of the initial shipment type) unless the consignee chooses to pay for the difference in expedited shipping. If your item was sent via freight truck and it was signed for and accepted, the order cannot be returned unless shipping is paid both ways by the customer and the item has not been opened or used/installed. If there is damage, part error, or loss in delivery, your replacement parts will be issued. *Please save a copy of all warranty, receipts, and delivery receipts for your records.
REPLACEMENT SHIPMENTS FOR DAMAGED ORDERS
If an order is refused at time of delivery due to damage, Scottsswingset.com will resend a new package out as soon as the damaged item is returned to the Gorilla Playsets warehouse. The order must be canceled with Scottsswingset over the phone to avoid having a re-shipment. Please call Scottsswingset immediately if this situation occurs (6319885673). *Please have a copy of all warranty, receipts, or delivery receipts when you call.
CANCELING A RECENTLY PLACED ORDER
As long as an order has not been processed, your order can be canceled. Orders cannot be canceled after shipment has already occured, or if the item is in mid-route. If you decide to cancel a recent order please contact me immediately at 6319885673.
